1. Contractual Framework and Purpose
These Terms of Use (hereinafter "ToU") constitute a legally binding contract between the user (hereinafter "you") and the publisher of the ZikLive application.
The use, consultation, or downloading of ZikLive services implies full and unreserved acceptance of these terms. If you do not agree with all these clauses, you must immediately stop using the platform.
2. Scope of Services and Availability
ZikLive provides a music event aggregation service, artistic content curation, and personal preference management. While we strive to ensure 24/7 access:
ZikLive reserves the right to interrupt access for technical maintenance or application updates without prior notice.
Service performance depends on the quality of your internet connection. ZikLive cannot be held responsible for latencies related to global network infrastructures.
3. Responsibility and Account Integrity
Access to certain features (favorites, personalized notifications) requires authentication via a third-party provider. You are the exclusive guardian of the confidentiality of your access.
- Any activity carried out under your identifier is presumed to be performed by yourself.
- In case of detection of abnormal or suspicious activity, ZikLive reserves the unilateral right to suspend or terminate your account without prior notice.
- It is strictly forbidden to attempt to bypass, disable, or alter the security measures of the ZikLive API.
4. Intellectual Property and Licenses
All elements constituting the application (source code, recommendation algorithms, database, user interface "Look & Feel", logos, brands) are protected by copyright and trademark law:
ZikLive grants you a personal, non-exclusive, non-transferable, and revocable license to use the application within a strictly private framework. Any reverse engineering, decompilation, or automated extraction (scraping) of event data is subject to legal prosecution.
5. Disclaimer (Exoneration)
ZikLive acts as an information intermediary and not as an organizer. Consequently:
Accuracy : We do not guarantee the absolute accuracy of information transmitted by third parties (venues, schedules, ticket prices).
Damages : ZikLive cannot be held responsible for direct or indirect damages resulting from the cancellation of an event displayed on the platform.
Third-Party Links : The application may contain links to merchant sites (ticketing). ZikLive has no control over these sites and declines all responsibility for their transactions.
6. Conduct and Termination
Failure to comply with any of the clauses of these ToU or any abusive use aimed at harming ZikLive's image may result in: (i) a formal warning, (ii) temporary restriction of services, or (iii) permanent closure of your access.
7. Revision Clause
ZikLive reserves the discretionary right to update these ToU to reflect technical or legislative developments. The version in effect at the time of your connection applies.
8. Governing Law and Disputes
These ToU are governed by French law. In case of dispute, the competent courts will be those of the publisher's jurisdiction.
